Bay Harbor Islands is two filled islands in Biscayne Bay: single-family houses on the West Island, apartment and condominium buildings and the business district on the East. The building stock
In 1945 Shepard Broad bought two undeveloped mangrove islands off 96th Street and filled them in; the town was incorporated in 1947 and the Broad Causeway opened in 1951. The West Island is single-family homes only, and the East Island holds the multifamily buildings and the business district. Census figures put the median year built at 1970, with 71 percent of homes built before 1980, and 77 percent of homes are in buildings of ten or more units.
The town says it lies entirely in a floodplain and takes part in the National Flood Insurance Program’s Community Rating System.
The town roof code
Town Code section 5-18 allows clay tile, concrete tile, solid-colored or variegated cement tile, thick-butt variegated slate, metal when consistent with the use and architecture, or other materials the Design Review Board approves. A roof pitched under 2½ inches per foot is built-up roofing with gravel, and a flat roof that cannot be seen from the street or neighboring lots may use modified bitumen or another approved membrane. An older nonconforming roof may be maintained, but its replacement must meet the list, and every rebuilt roof needs Design Review Board or staff approval. Roof colors need a permit and the Town Manager’s approval of a color sample.
Permit applications are notarized by owner and qualifier and go through the town’s Citizenserve portal, with the Miami-Dade HVHZ uniform roofing application and product approvals, a letter of authorization from the condominium or management association, and a recorded notice of commencement posted before the first inspection. Construction is allowed only 9 a.m. to 6 p.m. on weekdays, never on weekends or legal holidays.

Every rebuilt roof needs Design Review Board or staff approval, and any roof color needs the Town Manager’s approval of a sample. Condominiums add the association’s authorization letter.
